Remember, a listing agent is a fine person - one who works hard for their clients...but they simply cannot represent both sides of the transaction! If you were involved in a legal situation, would you go to your opponents' attorney and ask that lawyer to represent you as well? Of course not! It wouldn't even be legal.
Actually dual agency is not legal in real estate! But the State of Tennessee has provided a remedy for this huge conflict of interest. Want to know what that remedy is? Since the agent cannot legally represent both sides - the State has decided that they simply cannot represent either side! What?? Yes, you read this right! When the listing agent brings the buyer into the transaction - they must have a SIGNED DOCUMENT that releases them from their loyalty to the seller. And also at the same time it releases them from any loyalty to the buyer. Legally - they must revert to a 'facilitator' status, which means that they can only do the paperwork. They are no longer allowed to advise either party! And it must be signed by all parties involved in the transaction...the agent, the seller and the buyer. Sadly, I don't believe this is explained to either side - because who would agree to something like this? Especially when you consider that buying a home is one of the largest transactions most people make in a lifetime! This is why using the services of your own personal Exclusive Buyer's Agent is so important! We urge you to interview buyer's agents to determine who is the best fit for your specific requirements.
Yes, yes and yes! Don't be fooled into thinking that you can get a better deal if you go into a new development and buy from the salesperson! That salesperson works exclusively for the builder and the price is almost always the same whether you have your own agent or not. The commission is built into the price of the home. Many times, your Exclusive Buyer's agent can negotiate for more amenities or upgrades on your behalf.
Would you believe 'nothing'? The real estate commission is still paid by the seller. As part of the listing agreement, the agent and seller agree on the fee to be paid. Then that fee is split between agencies at closing. If you feel the need to pay your own buyer's agents fee, that can be negotiated as well, but it isn't necessary. Wouldn't you think that having that superior level of 100% loyalty and representation...with no additional cost to you...is a 'no-brainer'!
Another thing...we are not 'salespeople'! Nor do we care to be! You've already decided to buy a house - we don't have to 'sell' you. We are here simply to make sure you have all the information you need to make the best possible decision for your family! We offer you a critical view of any home and point out all the 'red flags' that we see from our years of experience. We don't see a lot of homes in flood zones...but one of the first things we do is check the flood maps just to be sure you won't end up having to pay the high premiums for flood insurance. The Nashville area flood maps were re-drawn after the flood of 2010 - but many times the flood certification isn't done until it gets to the title company. But, by this time you have already spent money for the appraisal, home inspection, termite inspection, etc. We believe in getting ahead of any problem to save you all the money we can.
